What Is An Adjustment To Status?

Adjustment of status is a process by which an alien beneficiary of an immigrant visa petition may obtain permanent residency from the USCIS without the necessity of seeking an immigrant visa at a U.S. consulate abroad. To be statutorily eligible, aliens must be:

  • Last inspected, admitted or paroled into the USA

  • Have an immigrant visa priority date immediately available
  • Not be subject to a statutory disqualifier

  • Be admissible to the USA

There are limited exceptions to these requirements. Eligibility is a complicated legal analysis best left to an immigration lawyer.
