How do you qualify for asylum?

Many individuals come to the United States seeking a better life for themselves and their families. There are many reasons people want to come to the country and a common reason is to escape a situation in their home country.

If you are fleeing persecution in your home country, you might qualify for asylum. However, you must meet certain requirements to qualify for asylum and becoming eligible can be quite challenging.

Contrary to what you may have heard or believe, you typically cannot qualify for asylum because of a generally negative situation in your home country. A lack of jobs, resources or a high rate of poverty or violent crime are not factors that qualify someone for asylum.

To be eligible for asylum, you must meet the definition of refugee in the Immigration and Nationality Act (INA).

What is a refugee?

Under this definition, a refugee is someone who must flee their home country because of persecution or a well-founded fear of persecution from their government because of their race, religion, nationality or political opinion.

Refugees seeking asylum based on persecution or a well-founded fear of persecution based on your sexual orientation, gender identity or HIV status must show that their fear of persecution is based on past persecution or a risk of future persecution. This persecution can be from a government or a non-government individual that the government is unable or unwilling to control.

Categories of persecution

Proving persecution is often the most challenging aspect of qualifying for asylum. Persecution falls into five broad categories including serious physical harm, coercive medical or psychological treatment, disproportionate punishment for a criminal offense, severe discrimination and economic persecution or severe criminal extortion.

You have the burden of proving that you meet the definition of a refugee and qualify for asylum. Although your own testimony can be sufficient, additional evidence, such as witnesses or documents, increase your chance of success.

You can file for asylum within one year of entering the United States

For a long time, the asylum program offered a way for immigrants to escape dangerous conditions in their home countries and seek better lives for themselves, However, in recent years, both the Biden and Trump administrations have sharply limited the use of the asylum program.
