What Is An Adjustment To Status?
Adjustment of status is a process by which an alien beneficiary of an immigrant visa petition may obtain permanent residency from the USCIS without the necessity of seeking an immigrant visa at a U.S. consulate abroad. To be statutorily eligible, aliens must be:
Last inspected, admitted or paroled into the USA
- Have an immigrant visa priority date immediately available
Not be subject to a statutory disqualifier
Be admissible to the USA
